Intellectual Property

The American Business and Technology University recognizes and encourages the individual effort on the part of its employees, faculty, and students leading to the creation of intellectual property.  It is the college’s intent to protect the rights of the individual, the college, and the sponsoring entity (if involved) and to effectuate reasonable and appropriate sharing of the fruits of the enterprise if the creations have commercial value.

Intellectual property, as defined by the United States Patent and Trademark Office, is the ownership of a dream, an idea, an improvement, an emotion that can be touched, seen, heard, or felt.  It is an asset.  Intellectual property is generally characterized as non-physical property that is the product of original thought, according to the Stanford Encyclopedia of Philosophy.

Intellectual property shall include the legal rights to a work as provided by applicable statue, regulation or judicial decision, including but not limited to, patent, copyright, trademark, service mark, trade secret, domain name registration, mask work, or plant variety protection certificate.

ABTU shall be the sole owner of intellectual property produced by any staff member or contract employee If that intellectual property is related to ABTU’s operation of providing classes, programs, and any degrees offered.  ABTU shall have exclusive right to commercially utilize any work or intellectual property that is created by any staff member or contract employee with or without substantial college assistance.

The ABTU usage, creator usage, commercial usage, and all aspects of the proposed development shall be facilitated by the ABTU President, the ABTU Dean of the College, and the ABTU Intellectual Property Committee.  The committee, which is composed of the ABTU President, Dean of the College, and the Compliance Officer, meets as needed to discuss any questions or matters regarding intellectual property.

ABTU will be responsible for all costs or expenses of legal protection for the intellectual property.
